In this book MacDonald guides his reader through Luke-Acts from beginning to end to identify and interpret the author’s imitations of classical Greek poetry, arguing that Luke’s two-volume work was a prose epic to provide his readers with a foundation myth for the new social reality that the Christian Church had become.

Much working time is spent in meetings and, as a consequence, meetings have become the subject of multidisciplinary research. Virtual Meeting Rooms (VMRs) are 3D virtual replicas of meeting rooms, where various modalities such as speech, gaze, distance, gestures and facial expressions can be controlled. This allows VMRs to be used to improve remote meeting participation, to visualize multimedia data and as an instrument for research into social interaction in meetings. This paper describes how these three uses can be realized (...) in a VMR. We describe the process from observation through annotation to simulation and a model that describes the relations between the annotated features of verbal and non-verbal conversational behavior. As an example of social perception research in the VMR, we describe an experiment to assess human observers’ accuracy for head orientation. (shrink)

In this study, we examine investor and firm response to the California Transparency in Supply Chains Act of 2010. The CTSCA requires large retail and manufacturing firms to disclose efforts to eradicate slavery and human trafficking from their supply chains and is a rare example of mandated corporate social responsibility disclosure. Based on a sample of 105 retail companies subject to the CTSCA, we find a significant negative market reaction to the passing of the CTSCA. Furthermore, we find that the (...) reaction is significantly more negative for larger firms and companies facing greater supply chain risks, suggesting that investors place a negative value on exposure to legitimacy threats in the social domain. With respect to company disclosure response, we document relatively high compliance with the legislation, although we also find that the disclosure response appeared to be more symbolic than substantive in nature. Finally, our analysis indicates that both disclosure choice and disclosure extensiveness were significantly higher for the high-supply chain risk companies, suggesting that the response was influenced by concerns with strategic legitimation. Overall, the limited quality of disclosure suggests that, without additional rules and guidance, mandates alone may not lead to meaningful social disclosure. (shrink)

In searching for appropriate business ethics for the 21st century, it is necessary to embrace a range of inter-related disciplines such as psychology and ethics, but also areas including philosophy, politics and religion. This text acts as an example of interdisciplinary scholarship.

Controversy persists over the ethics of compensating research participants and providing posttrial benefits to communities in developing countries. Little is known about residents' views on these subjects. In this study, interviews about compensation and posttrial benefits from a hypothetical HIV vaccine trial were conducted in Uganda’s Rakai District. Most respondents said researchers owed the community posttrial benefits and research compensation, but opinions differed as to what these should be. Debates about posttrial benefits and compensation rarely include residents' views like these, (...) but future ones should. (shrink)

In a recent comment on H.L.A. Hart’s ‘Postscript’ to The Concept of Law, Ronald Dworkin claims that the meaning of legal and political concepts may be understood by analogy to the meaning of natural kind concepts like ‘tiger’, ‘gold’ and ‘water’. This article questions the efficacy of Dworkin’s claims by challenging the use of natural kinds as the basis for a semantic theory of legal and political concepts. Additionally, in matters of value there is no methodological equivalent to the (...) scientific method. Thus, there is little hope of finding hidden essences to explain the meaning of legal and political concepts. Finally, even if there are natural kinds, Dworkin’s arguments for their efficacy in jurisprudence are problematic and unpersuasive. The problem for Dworkin is that his embrace of natural kinds undermines the ‘fit’ side of the fit/justification model of adjudication that lies at the heart of his theory of law. (shrink)

Ronald Dworkin famously argued that legal positivism is a defective account of law because it has no account of Theoretical Disagreement. In this article I argue that legal positivism—as advanced by H.L.A. Hart—does not need an account of Theoretical Disagreement. Legal positivism does, however, need a plausible account of interpretation in law. I provide such an account in this article.

As questões de justiça não dizem respeito apenas à determinação dos critérios de igualdade que devem orientar as regras jurídicas, mas também afetam a própria legitimidade da escolha desses critérios. Em virtude das experiências trágicas vividas no século XX e da impossibilidade de estabelecer um mecanismo perfeito de escolha social, o debate recente sobre os critérios justos de igualdade deve ser contextualizado em uma discussão mais ampla que envolva também questões atinentes à legitimidade política e à estabilidade dos regimes democráticos (...) apesar do forte desacordo ocasionado pelo pluralismo. O presente trabalho tem como objetivo comparar as teorias políticas de Ronald Dworkin, Amartya Sen e John Rawls quanto ao modo como se posicionam frente ao desacordo político com respeito a quais seriam os critérios justos de igualdade a serem incorporados na legislação. This chapter discusses the theory of international law. In analytic jurisprudence, at least since the latter half of the twentieth century, the primary debate in general jurisprudence has been between legal positivism and its most ardent critic, Ronald Dworkin. The positivist tradition is represented here by its two most important theorists, Hans Kelsen and H.L.A. Hart. During their careers, Kelsen and Hart clashed over the best understanding of legal positivism. For his part, Dworkin devoted the bulk of his critical (...) attention to Hart's work. The chapter also focuses on the way in which each theorist builds his view of international law against the background of a more general jurisprudence. Hart argues that the differences between international law and municipal law might eventually be overcome. International law might be in a stage of transition that will bring it nearer in structure to a municipal system. (shrink)

Science has always strived for objectivity, for a ‘‘view from nowhere’’ that is not marred by ideology or personal preferences. That is a lofty ideal toward which perhaps it makes sense to strive, but it is hardly the reality. This collection of thirteen essays assembled by Denis R. Alexander and Ronald L. Numbers ought to give much pause to scientists and the public at large, though historians, sociologists and philosophers of science will hardly be surprised by the material covered (...) here. This paper explores a new reason for preferring a model-theoretic approach to understanding the nature of scientific theories. Identifying the models in philosophers' model-theoretic accounts of theories with the concepts in cognitive scientists' accounts of categorization suggests a structure to families of models far richer than has commonly been assumed. Using classical mechanics as an example, it is argued that families of models may be "mapped" as an array with "horizontal" graded structures, multiply hierarchical "vertical" structures, and local "radial" structures. From the perspective of cognitive science, it is illuminating to think of much contemporary scientific research as taking place in distributed cognitive systems. This is particularly true of large-scale experimental and observational systems such as the Hubble Telescope. Clark, Hutchins, Knorr-Cetina, and Latour insist or imply such a move requires expanding our notions of knowledge, mind, and even consciousness. Whether this is correct seems to me not a straightforward factual question. Rather, the issue seems to be how best to develop (...) a theoretical understanding of such systems appropriate to the study of science and technology. I argue that there is no need to attribute to such systems as a whole any form of cognitive agency. We can well understand the importance of such systems while restricting agency to the human components. The implication is that we think of these large-scale distributed cognitive systems not so much as unified wholes, but as hybrid systems including both physical artifacts and ordinary humans. Discourse around assisted colonization focuses on the ecological risks, costs, and uncertainties associated with the practice, as well as on its technical feasibility and alternative approaches to it. Nevertheless, the ethical underpinnings of the case for assisted colonization are claims about the value of species. A complete discussion of assisted colonization needs to include assessment of these claims. For each type of value that species are thought to possess it is necessary to determine whether it is plausible that species possess (...) the type of value and, if so, to what extent their possessing it justifies assisted colonization. I conducted such an assessment for each of the predominant types of value ascribed to species: ecological, instrumental (including option value), existence, and intrinsic value (including interest‐based, objective, and valuer‐dependent intrinsic value). The vast majority of species, including several that have been proposed as candidates for assisted colonization, have much less value than is often presumed. Moreover, with respect to some types of value, assisted colonization would not fully preserve the value of the target species even if it were to keep the target species in existence. Therefore, the case for assisted colonization is significantly weaker and more qualified than its advocates often suppose. There may be exceptional species for which assisted colonization is well justified—and for this reason, case‐by‐case assessment is necessary—but in general the burden of justification generated by the ecological risks associated with assisted colonization is not met by the value potentially preserved by assisted colonization. This suggests that assisted colonization ought to have, at most, a very minor role in the portfolio of ecosystem management practices, even as it pertains to species conservation under conditions of rapid climate change. Until now it has been impossible to read the full story of the relationship between Albert Camus and Jean-Paul Sartre. Their dramatic rupture at the height of the Cold War, like that conflict itself, demanded those caught in its wake to take sides rather than to appreciate its tragic complexity. Now, using newly available sources, Ronald Aronson offers the first book-length account of the twentieth century's most famous friendship and its end. Albert Camus and Jean-Paul Sartre first met in (...) 1943, during the German occupation of France. The two became fast friends. Intellectual as well as political allies, they grew famous overnight after Paris was liberated. As playwrights, novelists, philosophers, journalists, and editors, the two seemed to be everywhere and in command of every medium in post-war France. East-West tensions would put a strain on their friendship, however, as they evolved in opposing directions and began to disagree over philosophy, the responsibilities of intellectuals, and what sorts of political changes were necessary or possible. As Camus, then Sartre adopted the mantle of public spokesperson for his side, a historic showdown seemed inevitable. Sartre embraced violence as a path to change and Camus sharply opposed it, leading to a bitter and very public falling out in 1952. They never spoke again, although they continued to disagree, in code, until Camus's death in 1960. In a remarkably nuanced and balanced account, Aronson chronicles this riveting story while demonstrating how Camus and Sartre developed first in connection with and then against each other, each keeping the other in his sights long after their break. Combining biography and intellectual history, philosophical and political passion, _Camus and Sartre_ will fascinate anyone interested in these great writers or the world-historical issues that tore them apart. Using the Schwarzschild calculation of the Relativistic bending of starlight near the sun as an illustration, it is shown that the relationship between theory and data requires a hierarchy of structures of different logical type. An essential feature of this hierarchy is the use of idealizations and approximate truths. On the basis of a counterfactual analysis of these concepts, it is shown that confirmation is possible even though statistical measures of goodness of fit are not satisfied. The consequences of this (...) view of confirmation and hierarchical structure for scientific realism are then considered. (shrink)

In this paper, I will develop a nontrivial interpretation of Feyerabend's concept of a hidden anomalous fact. Feyerabend's claim is that some anomalous facts will remain hidden in the absence of alternatives to the theories to be tested. The case of Brownian motion is given by Feyerabend to support this claim. The essential scientific difficulty in this case was the justification of correct and relevant descriptions of Brownian motion. These descriptions could not be simply determined from the available observational data. (...) An examination, however, of this case shows that no alternative theory is or historically was thought to be necessary in order to justify descriptions of Brownian motion that "directly" refute thermodynamics. While Feyerabend's appraisal of this case therefore is incorrect, a sense is developed in which successful alternatives lend inductive support to the correctness of refuting experimental descriptions. Crucial though to the explanation of this support is the notion of arguments that show the possibilities for improving experimental fit. (shrink)

Gott ( 1993 ) has used the ‘Copernican principle’ to derive a probability distribution for the total longevity of any phenomenon, based solely on the phenomenon’s past longevity. Leslie ( 1996 ) and others have used an apparently similar probabilistic argument, the ‘Doomsday Argument’, to claim that conventional predictions of longevity must be adjusted, based on Bayes’s Theorem, in favor of shorter longevities. Here I show that Gott’s arguments are flawed and contradictory, but that one of his conclusions is plausible (...) and mathematically equivalent to Laplace’s famous—and notorious—‘rule of succession’. On the other hand, the Doomsday Argument, though it appears consistent with some common‐sense grains of truth, is fallacious; the argument’s key error is to conflate future longevity and total longevity. Applying the work of Hill ( 1968 ) and Coolen ( 1998 , 2006 ) in the field of nonparametric predictive inference, I propose an alternative argument for quantifying how past longevity of a phenomenon does provide evidence for future longevity. In so doing, I identify an objective standard by which to choose among counting time intervals, counting population, or counting any other measure of past longevity in predicting future longevity. *Received May 2007; revised October 2008. †To contact the author, please e‐mail: [email protected].
